Petitioning I remove content simply because you disagree does not suffice.
I do what I can to abide by the safe harbor provisions of 17 U.S.C. §512, otherwise known as Digital Millennium Copyright Act (“DMCA”). Photos on this blog are either my own or from Pexels.com and Openverse, and thus free for me to use. All other material I quote, display, reference, or link to constitutes fair use as my blog is non-commercial. I feel I am allowed to display, link to, and describe other content in the form of criticism, commentary, research, instruction, and analysis—but if you still think I should remove something, here is the only way to do it.
To contact me about a potential copyright infringement, I need a detailed, written explanation via email ONLY that includes at least the following:
- Initial correspondence from an email address tied to a domain representing you and/or your company. If it comes from a “free” email (e.g. Gmail, Outlook, iCloud, etc) address, I will report the message as spam and block you. If you pay for a domain for your business, you should be able to host your own email as well. (I will also check the WHOIS data for your domain and the header in your email, along with other kinds of background checks, to further verify you.)
- Some kind of linked (read: no attachments) visual or documented proof, that is hosted on your domain’s server, that you are the owner, or their legal representative, of the allegedly infringement, and a statement that the information provided is accurate, verifiable, and up-to-date. Photos sent directly through emails can easily be forged, and will be dismissed as spam; showing them on your domain gives legitimacy to your claim.
You must upload to your company’s host server and then send me the direct link to your proof identity and work ownership. Messages without these direct links, like those utilizing URL shorteners, will be ignored and deleted. - Identify the material that you want modified or removed. Providing URLs of the content you dispute will help me locate content quickly.
- A short and to-the-point reason explaining why how I use your content of is not fair use; not allowed to be re-published non-commercially, linked to, analyzed, etc; or allowed to be critiqued. Simple disagreement, differences in politics/points-of-view/ideology/whatever, “deeply held or sincere beliefs” or other such convictions, or because you hate same-sex relationships are not valid enough reasons for me to take down or alter my material.
- I will not accept any kind of bribe to change my opinion on something.
- I will not accept take-down requests through social media. Just because you pay for a “verification” badge doesn’t mean anything, when anyone now can pay for that badge.
- You must submit your request as an email, NOT as a blog comment—these kinds of blog comments will be ignored and deleted.
Under Section 512(f) of the DCMA, if you knowingly lie about me infringing upon others’ work, you may be subject to liability for damages. In other words, DON’T MAKE FALSE CLAIMS!
General Copyright Statement (aka the TL;DR): Anything posted is due to the “fair use” doctrine of copyright law for non-commercial purposes, especially for me to express an opinion, critique, or commentary; I don’t profit from this blog and am exercising my right to free speech. However, if you can civically explain why material should be edited, altered, or otherwise removed, I may concede. Excuses such as differences of opinion, that you don’t like what I wrote or how I published things, you don’t like the fact that I am a butch lesbian and queer woman, and other pedantries do not suffice enough merit for removal, altercation, etc.
Initially created October 3, 2021. Updated April 23, 2023 to show that I only accept correspondence from verified email accounts, because social media “verification” can be done by anyone who has a few bucks to spare, which no longer guarantees that the send is the actual party conversing with me.
